Privacy Charter – Personal Data Processing Regulation

1. General Information

This Privacy Charter applies to any activity, commercial operation or services performed by the companies SA VERMEIRE TRANSMISSIONS and NV VERMEIRE AANDRIJVINGEN, operating under the trade name “VERMEIRE BELTING”. This Charter is available on the https://www.vermeire.com/fr/respect-de-la-vie-privee website (hereinafter, the “Website”, and subject to any other contractual documents governing certain services provided by VERMEIRE BELTING.)

This Privacy Charter belongs to the company SA VERMEIRE TRANSMISSIONS, whose registered office is located at Rue de la Filature, 41 B-4800 ENSIVAL (VERVIERS), registered in the CBE under No. 0402.475.467 and the company NV VERMEIRE AANDRIJVINGEN, whose registered office is located at Gaston Crommenlaan 8 in B-9050 GENT, registered in the CBE under No. 0869.758.913.

 (hereinafter, referred to as “VERMEIRE BELTING.”, the “Provider”, the “Controller” or “Us”). 

This Privacy Charter of VERMEIRE BELTING (hereinafter the “Privacy Charter”) applies to relations between VERMEIRE BELTING and third parties (customers, service providers, suppliers, etc.).

The management of your personal data implies compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

VERMEIRE BELTING only collects personal information provided it is supplied on a voluntary basis (consent), or is justified due to contractual or pre-contractual measures as well as due to a legal obligation required of it.

By reading this Charter and by communicating your consent or contractually committing yourself to VERMEIRE BELTING, you acknowledge that you have read and accepted the terms and conditions set out in this Charter as well as the processing objectives and methods that it implies.

This Charter is supplemented by the legal notices and by a Cookie Policy.

3. Legal Basis of the Processing

The data can be collected on the basis of the consent of the data subject, with consent given in a specific, free and informed way.

We can ask you for your consent in writing or by electronic means. After having given your consent, you may withdraw it at any time.

At a pre-contractual stage, the data may also be collected on the basis of the fact that these are necessary for undertaking the said pre-contractual measures, taken at the data subject’s request.

When VERMEIRE BELTING concludes a contract with the data subject, processing of the personal data collected is necessary for the performance of the contract concluded between the parties. 

After performance of the contract, the data subject consents to their personal data transmitted continuing to be processed by VERMEIRE BELTING if the processing is made necessary by a dispute between VERMEIRE BELTING and the data subject or because of a particular legal obligation imposed on it.

In some cases, it may be that we process your personal data because the applicable laws in force require or permit us, for example, to prevent, detect and investigate fraud or offences or to comply with specific tax obligations.

In many cases, we process your personal data because we have a legitimate commercial interest to do so. §  The site via which you arrived;

§  Generally, any information given voluntarily when using VERMEIRE BELTING services or any request made on the Website.

 

These data are collected for the following purposes:

§  Allowing these data to be used for commercial prospecting and for the purposes of marketing by the company VERMEIRE BELTING;

§  For the purpose of communicating with you;

§  Concluding, performing and terminating contracts relating to our products and / or services;

§  Carrying out assessments and taking decisions regarding the conditions of these contracts;

§  Supplying products and / or services that we offer;

§  Improving the quality of our products and / or services;

§  Ensuring the security of the premises and facilities of VERMEIRE BELTING;

§  Allowing these data to be used as part of the contractual relationship between the company VERMEIRE BELTING and the data subject;

We will also retain all optional information given voluntarily by the user for direct marketing purposes and to improve the Website. The history of requests and written communications is also retained to facilitate management of the relationship with the user.

5. Security and Confidentiality

We are highly attentive to the security and confidentiality of your data. We use recognised securing processes to ensure the security of the transmission of your data.

In order to improve the service offered to its users, VERMEIRE BELTING studies statistics relating to visits to its website. The study of these data does not however not relate to any personal data.

The VERMEIRE BELTING website uses cookies to store certain information between two visits of the user to its website.

Personal data will be processed strictly informally, which means that personal data will only be processed and employees will only have access to the personal data when this is necessary for the type and scope of the task in question. Employees are prohibited from using personal data for private or commercial purposes, from disclosing them to any unauthorised persons or from making them available in any other way.

6. Retention Period

Your personal data processed by VERMEIRE BELTING are retained for the period strictly necessary to achieve the purposes stated in Article 3 above, from the pre-contractual discussions until the expiry of the contract concluded between the parties, unless data retention subsequent to the contract is imposed by a law, decree or order, or due to a conflict requiring the use of personal data by the company. The exact period will depend on the specific purpose for which we are retaining your personal data.

7. Proportionality

VERMEIRE BELTING. ensures that the personal data collected are appropriate, relevant and not excessive, given the processing purposes indicated in Article 4 of this Charter. 

8. Rights of Individuals

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, you have the right to access your personal data and the right to modify them. You can send your requests to view or  modify them or object to their use, by contacting us at the address stated in Article 2 of this document present (by sending us a copy of your identity card). 

You must have the right to obtain confirmation of the processing or otherwise of your personal data, and, if applicable, to access your personal data and your information regarding the processing;

You may request the correction of erroneous, inaccurate or incomplete data.

You have the right to object to the processing of your personal data for certain reasons and the right at any time to object to the use of your personal data for direct marketing purposes;

If you have consented to us processing your personal data, you have the right to withdraw your consent at any time, without this withdrawal affecting the legality of the processing undertaken on the basis of the consent given before its withdrawal;

In the event of an individual automated decision, to obtain a human intervention, to give your point of view, to receive an explanation of the automated decision and to challenge this decision.

Subject to certain conditions, you have the right to (i) have your personal data erased. Where your personal data have been made public, VERMEIRE BELTING will take reasonable steps to inform the personal data controllers of your request to erase your personal data and to inform the personal data recipients of your request to erase your personal data; (ii) you have the right to obtain a restriction on the processing of your personal data and, in the event of a restriction, to limit the processing to simple storage; and (iii) you have the right to receive your personal data, that you may reuse as you wish. If you so request, VERMEIRE BELTING must transfer your personal data directly to another data controller.

You also have the right to request limitation of the processing related to your data, as well as the right to portability of your data.

In addition, emails or newsletters that may be communicated to you will include a link that you can click to no longer receive promotional information from us. 

9. The User’s Responsibilities

Although the company VERMEIRE BELTING makes all possible efforts to protect your privacy, effective protection is of course only possible if you yourself also take the measures required to preserve your privacy.

In your capacity as the data subject, you are required to:

- provide complete, accurate truthful and non-deceptive information;

- take care to duly ensure the privacy of any user data (such as a user name, a password, a token or a PIN code), so that these data remain accessible to you only. These data are strictly personal and non-transferable;

- send valid and usable contact information so that you can be contacted in a reasonable time and in a reasonably confidential way.

10. Sharing and Transferring Data

Within the context of the purposes described above in Article 4, we may share your personal data with third parties, called “recipients”.

These third parties (recipients) may include:

§  Third-party providers of external services (e.g. auditors, experts, lawyers and other professional advisers; travel and medical assistance providers; computer systems, providers of hosting services, banks and financial institutions, administrators of third party complaints and other third party providers) who assist us in carrying out commercial activities);

§  Governmental authorities;

§   Third-party participants in judicial procedures and their advisers; and

§  Other third parties (rating agencies, suppliers of commercial information, buyers and potential buyers or other parties within the framework of any reorganisation, sale, joint-venture, merger, assignment, transfer or another, actual or proposed operation, relating to our activities, assets, companies or actions).

VERMEIRE BELTING may receive or transfer personal data of data subjects to third countries outside the European Union.

Due to the global nature of our activity, we may transfer your personal data to entities (recipients) located in countries outside the EEA which do not offer adequate protection of personal data.

If personal data are transferred from the EEA to a country outside of it which does not offer adequate protection of personal data, we will ensure that appropriate protection measures are put in place to protect your personal data in line with standards equivalent to the standards contained in this document. In other words, VERMEIRE BELTING will remain the Controller of your personal data and will take the measures necessary to protect their processing.

As regards any possible transfer to a third country, VERMEIRE BELTING guarantees that this transfer will be carried out in a lawful manner and in accordance with the principles set out in Articles 44 and following of the European Data Protection Regulation.

11. Marketing Preferences

If you are a current or past customer, we will provide you with opportunities to inform us of your marketing preferences. You can decide to change your marketing preferences at any time. You can also choose not to receive marketing communications.

The marketing communications used by VERMEIRE BELTING may include the following elements:

§  Receiving email and SMS messages from us;

§  Receiving telephone communications and postal or digital letters from us;

§  Sharing your personal data with us for marketing purposes; and

§  Sharing your personal data with selected third-party partners for marketing purposes.

12. Amendment of the Charter

This Charter may be amended at any time by VERMEIRE BELTING. depending on the changes made to the Website and to the services available through it, of changes to the legislation or for any other legitimate reason. 

These amendments come into force immediately once they are put online. If applicable, an email will be sent to you to notify you of these changes.
